Nonrenewal
Purpose
Rather than dismiss a resident from his/her training program, the College of Medicine may choose not to renew a resident's employment agreement beyond the expiration of the current fiscal year. Notice of nonrenewal must be given no less than 120 days prior to the expiration of the resident's employment agreement, and must be based upon "just cause."
Procedures
- After the Program Director or Department Head determines that just cause exists not to renew a resident's employment agreement, the Program Director or Department Head will inform the resident in a private meeting with the Program Director or Department Head that his/her contract will not be renewed for a successive year.
- The Program Director or Department Head will either hand-deliver or mail a written Notice of Action to the resident stating that the resident will not be continued in the training program, which will include an explanation of the specific bases for the decision.
- The Program Director will notify the resident of his/her right to request a meeting to review the decision, which will include a copy of these Due Process Guidelines.
- If the resident requests a meeting with the DRC, the procedures set forth above for review of the decision will apply.
