Notice of Action
- The Program Director will notify the resident in writing of his/her decision to impose disciplinary action using the Notice of Action Form appended to these procedures as Appendix A.
- The Notice of Action will state the nature of the action, the specific bases for the action and the just cause upon which the action is taken. It will include a short and plain statement of the relevant facts, including, if known, the time, date, and place of any incident or incidents giving rise to the action. The notice also will state the name of any complainant. The Notice of Action may be accompanied by a more complete statement of reasons for taking the action; however, such is not required, if the Notice of Action is complete in this regard.
- The Program Director will hand-deliver and/or mail the notice to the resident's last known address of record. The date of hand-delivery will be the effective date of the notice; if mailed, the notice will be effective 5 days from the date of mailing.
- The Program Director will notify the resident of his/her right to request a meeting with the departmental Discipline Review Committee (DRC) by including with the notice a copy of these Due Process Guidelines.
