Dismissal Procedures

Purpose
Dismissal will occur when a resident fails to meet program requirements or engages in conduct that constitutes just cause for dismissal. Dismissals will follow the procedures set forth below.

Procedures

  1. After the Program Director or Department Head determines that just cause exists to dismiss a resident, the resident will be informed in a private meeting with the Program Director or Department Head that s/he will be dismissed from the training program.

  2. The Program Director or Department Head will provide the resident with a written Notice of Action stating that the resident is being dismissed, which will include an explanation of the specific bases for the decision.

  3. The Program Director will notify the resident of his/her right to request a meeting to review the decision by including a copy of these Due Process Guidelines with the Notice of Action.

  4. A resident may accept the decision of the program director and submit a letter of resignation in lieu of dismissal from the program; however, the Notice of Action will remain in the resident’s official personnel file. If the resident tenders a resignation, s/he will not thereafter be entitled to a review of that decision before the DRC or to an appeal to the Graduate Medical Education Committee.

  5. If the resident requests a meeting to review the decision to dismiss, such dismissal will be effective only after a final decision is made on the matter.

  6. The resident will be entitled to receive his or her full compensation pending a final decision to dismiss him/her from the residency program.
